Terms of Use

These Terms of Use ("Terms") govern your access to and use of appistry.tech and any demo, prototype, or hosted application operated by Appistry (collectively, the "Service"). By using the Service you agree to these Terms; if you do not agree, please do not use the Service.

1. About us

Appistry is operated as a sole trader based in Kent, United Kingdom. Contact: hello@appistry.tech (general) or privacy@appistry.tech (data and privacy).

2. Definitions

  • "Showcase Site" means the marketing website at appistry.tech.
  • "Demo" means any interactive prototype, concept demo, or feature tour we publish on the Showcase Site.
  • "Hosted App" means a live application we operate on behalf of a client (for example, Holborough Lakes Social).
  • "You" means the individual or organisation accessing the Service.

3. Permitted use

You may use the Showcase Site to evaluate our work, request a consultation, and explore Demos. You may use Hosted Apps in accordance with any additional in-product terms shown when you sign up to that app.

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Attempt to gain unauthorised access to any account, system, or data.
  • Probe, scan, or test the vulnerability of the Service without our prior written consent.
  • Scrape, harvest, or copy content at scale, or use it to train any machine-learning model without our written permission.
  • Submit content that is defamatory, infringing, obscene, or otherwise objectionable.
  • Misrepresent your identity or impersonate any person or organisation.
  • Upload viruses, malware, or any code intended to disrupt the Service.

4. Accounts

If you create an account (admin or hosted-app user), you are responsible for:

  • Keeping your credentials confidential.
  • All activity that occurs under your account.
  • Telling us promptly if you suspect any unauthorised use.

We may suspend or terminate accounts that breach these Terms or pose a risk to other users.

5. Intellectual property

All content on the Showcase Site — including text, graphics, logos, mock-ups, code samples, screenshots, and Demos — is owned by Appistry or its licensors and is protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to view and interact with that content for personal, non-commercial evaluation only.

For Hosted Apps, intellectual-property ownership is governed by the agreement between Appistry and the operating client; the operator's in-product terms apply to your use.

6. User-submitted content

When you submit information through any form on the Service (contact, consultation, lead, vendor profile, photos, etc.) you confirm that:

  • You have the right to share that information.
  • The information is accurate to the best of your knowledge.
  • You grant Appistry a non-exclusive, worldwide, royalty-free licence to use, store, and process that information solely for the purposes set out in our Privacy Policy and to deliver the Service to you.

You retain ownership of anything you submit.

7. Demos are illustrative

Demos and prototypes are published to illustrate what is possible. Sample data shown is fictional unless explicitly labelled otherwise. Stat counters, metrics, and "live" indicators in Demos may be simulated. Do not rely on Demo behaviour as a guarantee of how a finished product will behave for your business — every build is bespoke.

8. Hosted applications

Hosted Apps may have their own in-product terms, fees (e.g. ticket purchases, donations, vendor stalls), refund policies, and codes of conduct set by the operating client. Those in-product terms apply alongside these Terms; in the event of conflict the in-product terms take precedence for use of that Hosted App.

9. Payments

Where the Service or a Hosted App takes payment (for example, ticketing, donations, sponsorships), payment is processed by a regulated third-party provider (e.g. Stripe). Refunds are subject to the operator's published refund policy and applicable consumer law.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Appistry disclaims all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law (including death or personal injury caused by negligence, or fraud). Subject to that:

  • Appistry will not be liable for any indirect, incidental, consequential, or special losses, or for loss of profit, revenue, goodwill, data, or business opportunity.
  • Appistry's total aggregate liability to you arising out of or in connection with these Terms or the Service is limited to £100 or the amount you have paid Appistry in the 12 months preceding the event giving rise to the claim, whichever is greater.

If you are using a Hosted App, the operating client may have separate liability terms — see the in-product agreement.

12. Indemnity

You agree to indemnify Appistry against any claim, loss, or cost arising from your breach of these Terms or your unlawful use of the Service.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or pose a risk. You may stop using the Service at any time; sections 5, 6, 10, 11, 12, 14, and 15 survive termination.

14. Changes

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Material changes will be highlighted on the homepage or by email where appropriate. Continued use of the Service after changes are posted constitutes acceptance.

15. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
